Terms of Service for Guest.Gallery

Welcome to Guest.Gallery. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the service.
1. Acceptance of Terms
By signing up for and using Guest.Gallery, you accept and agree to these Terms. If you do not agree with any part of these Terms, please refrain from using our services.
2. Description of Service
Guest.Gallery provides event-specific galleries with multiple package options tailored for private events. The exact scope, storage period, archive date, and any plan-specific limits are shown at checkout, on the pricing page, and in your account.
- Basic: 25GB total storage and up to three months of gallery access and storage from your selected activation or event date.
- Premium: "Unlimited uploads" for private use, subject to our Fair Use Policy. Designed for up to 100 guests with an expected allocation of up to 1GB per guest and currently includes up to twelve months of gallery access and storage. Contact us if you need higher limits or plan a commercial/public event.
Access to upload, view, and download content may change when an event reaches its archive date, or if we suspend or terminate the service under these Terms.
3. Fair Use Policy
- Scope: Applies to Premium or any plan marketed as "unlimited uploads" and is intended for private, non-commercial events only.
- Expectation: Unlimited is defined within the reasonable usage expectation of up to 100 guests and an average allocation of up to 1GB per guest for the event.
- Exceeding Limits: If you expect more guests, need higher per-guest allocations, or plan a public/commercial event, please contact us in advance at contact@guest.gallery to discuss options.
- Abuse Prevention: We reserve the right to apply reasonable technical or operational measures to protect the service from misuse that materially exceeds the expectations above or degrades the experience for others.
4. Eligibility
- Age Requirement: You must be at least 13 years old to use our services.
- Account Registration: You agree to provide accurate and complete information during registration and to keep this information up-to-date.
5. User Accounts
- Google Sign-In: Registration and login are conducted through Google sign-in. We collect your email address and name as provided by Google.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Unauthorized Use: Notify us immediately of any unauthorized use of your account.
6. User Content
- Ownership: You retain all ownership rights to the photos and videos you upload.
- License to Use Content: By uploading content, you grant Guest.Gallery a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content as necessary to provide the service.
- Content Responsibility: You are solely responsible for the content you upload. You represent that you have all necessary rights to upload the content and that it does not violate any laws or infringe upon any third-party rights.
- Prohibited Content: You agree not to upload content that is illegal, offensive, harmful, or violates any third-party rights.
7. Fees, Payments, Offers, and Extensions
- Payment: The service fee is payable at the time of activation, according to regional pricing.
- Payment Processor: Payments are processed securely through Stripe.
- Refunds: All fees are non-refundable unless required by law.
- Package Offer Benefits: Any promotional product, print allowance, upgrade, credit, or other benefit included with a package purchase is linked to the specific event for which the package was purchased. Unless the offer expressly states otherwise, the benefit may be redeemed only while that event is active and no later than the archive date shown in your account.
- Expiry and Forfeiture: When the event expires, any unused or partially unused offer benefit expires automatically and is forfeited. An expired benefit cannot be transferred to another event, exchanged for another product, or reinstated solely because it was not redeemed in time.
- No Cash Value or Compensation: Unused offer benefits have no cash value and do not qualify for a refund, credit, replacement, or other compensation solely because you did not redeem them before the event expired. This does not limit any mandatory rights or remedies you may have if we fail to make an included benefit available as agreed.
- No Automatic Event Extension: A package offer or an unused offer benefit does not keep an event active beyond its stated archive date. The archive date changes only if you purchase an extension or we expressly grant one and the extension is confirmed in your account.
- Effect of an Extension: An extension keeps the event active until the new archive date shown in your account. It does not automatically renew, replace, or reinstate an offer benefit that had already expired, unless the extension or offer expressly states otherwise.
8. Custom Printed Products, Returns, and Delivery
- Made-to-Order Products: Printed products such as pocket cards, QR cards, invitations, or other customized items are produced to your specifications and may include your selected text, design, quantity, event link, QR code, and other personalization choices.
- No Normal Right of Withdrawal: Because customized printed products are made to order and have a clear personal character, they are not covered by the normal right of withdrawal or return once the order has been placed, except where required by applicable law.
- Your Review Responsibility: Before placing an order, you are responsible for reviewing the design, spelling, names, dates, event link, QR destination, quantity, delivery address, email address, and any other order details. We are not responsible for customer-entered errors, including typos, incorrect event details, incorrect QR destinations, wrong quantities, incorrect contact details, or incomplete delivery information.
- Cancellation Before Production: If you need to cancel a customized print order, contact us immediately. We may be able to cancel the order if production has not started, but cancellation is not guaranteed.
- Delivery Estimates: Delivery times are estimates and may vary due to production load, carrier delays, holidays, or circumstances outside our control. If your printed products are needed for a specific event date, you are responsible for ordering in good time.
- Shipping Charges: Shipping for printed products in Denmark is DKK 49 per order and is charged separately, unless expressly stated otherwise, for example as part of an offer that includes shipping. The shipping charge is shown before you place the order.
- Freight Damage: If a product arrives damaged during shipping, contact us as soon as possible and preferably within four days of receipt. Please include photos of the damaged product, outer packaging, inner packaging, and shipping label, and keep the packaging until the case has been resolved. This documentation may be required before we can make a claim with the carrier or arrange a replacement.
- Missing or Incorrect Items: If you believe an item is missing or incorrectly supplied, contact us within a reasonable time after receiving the order and include photos of the received items and packaging where relevant. If the issue is due to an error on our part, we will work to correct it.
- Uncollected Packages and Address Errors: Not collecting a package is not a valid way to cancel a customized order. If a package is returned because it was not collected or because the delivery information you provided was incorrect or incomplete, you may be responsible for return fees, carrier costs, and any re-shipping costs.
- Statutory Rights: Nothing in this section limits any mandatory rights you may have under applicable consumer law for defective, damaged, missing, or incorrectly supplied goods.
- Email Delivery: Order confirmations, shipping messages, login links, archive reminders, and support replies are sent by email. Some email providers, including Hotmail, Live, Outlook, and Gmail, may filter transactional emails aggressively. Please make sure your email address is correct and check spam, junk, promotions, and other filtered folders if an expected email does not arrive.
9. Data Retention and Deletion
- Storage Duration: Your uploaded content is stored until the archive date associated with your plan and selected activation or event date.
- Post-Archive Processing: After the archive date, content may be moved, processed, or retained temporarily across our storage and processing providers to support archival, ZIP generation, recovery, operational integrity, or deletion workflows.
- Deletion Timing: We aim to delete active media from primary systems shortly after the archive date. In many cases this happens around 14 days after the archive date, but exact timing may vary due to technical, operational, legal, or security reasons.
- Residual Copies: Generated ZIP files and temporary archival, backup, cache, or recovery copies may remain for a limited period after archival and are generally removed within six months after the archive date, unless longer retention is required by law, dispute handling, fraud prevention, or system recovery needs.
- User Backups: You are responsible for keeping your own copies of content you want to retain. Guest.Gallery is not liable for any data loss after archival, deletion, account closure, or service suspension.
10. Privacy
Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
11. Intellectual Property Rights
- Service Materials: All materials on the service, including text, graphics, logos, and software, are owned by Guest.Gallery or its licensors and are protected by intellectual property laws.
- Restrictions: You may not reproduce, distribute, or create derivative works from any part of the service without prior written permission.
12. Prohibited Conduct
You agree not to:
- Use the service for any unlawful purpose.
- Upload viruses or malicious code.
- Attempt to gain unauthorized access to other users' accounts.
- Interfere with the operation or security of the service.
13. Third-Party Services
- Integration: Guest.Gallery integrates with third-party services such as Google for authentication, Stripe for payment processing, Supabase for application data and authentication infrastructure, Backblaze B2 and Cloudflare R2 for media storage and delivery, Hetzner for ZIP generation and media processing workflows, Resend for transactional emails, shipping carriers and fulfillment partners for print orders, and PostHog and Google analytics tools for product analytics and measurement.
- Third-Party Terms: Your use of these services is subject to their respective terms and privacy policies where applicable.
- Processor Changes: We may replace, add, or remove service providers from time to time as part of operating, securing, and improving the service.
14. Disclaimer of Warranties
- Service Provided "As Is": Guest.Gallery is provided on an "as is" and "as available" basis without warranties of any kind.
- No Guarantee: We do not guarantee that the service will be uninterrupted, error-free, or secure.
15. Limitation of Liability
- No Liability for Damages: Guest.Gallery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service.
- Maximum Liability: Our total liability to you for any claims arising from the service is limited to the amount you paid for the service.
16. Indemnification
You agree to indemnify and hold Guest.Gallery harmless from any claims, damages, losses, or expenses arising out of your use of the service or violation of these Terms.
17. Termination
- By You: You may terminate your account at any time by contacting us.
- By Us: We reserve the right to suspend or terminate your access to the service at our discretion, without notice, for conduct that violates these Terms.
- Effect of Termination: Upon termination, your right to use the service will immediately cease, and we may restrict access to or delete your content in accordance with our retention and deletion practices.
18. Changes to the Terms
We may modify these Terms at any time. Changes will be effective upon posting to this page with an updated date, subject to any notice or consent requirements under applicable law. Changes do not retroactively remove rights that have already accrued under a paid purchase. Your continued use of the service after changes are posted constitutes your acceptance of the updated Terms to the extent permitted by law.
19. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of Denmark, without regard to conflict of law principles.
- Dispute Resolution: Any disputes arising from these Terms or the service shall be resolved through Danish courts.
20. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms constitute the entire agreement between you and Guest.Gallery regarding the service and supersede any prior agreements.
